This is AMAZING! only minor minor minor gripe. No Blackest Night.

Well as the site says, they are a year behind in the books!! They urge readers to support their favorite comics by going to the shops and buying the latest issues!!!

I am sure that site is illegal some how .... marvel just needs to see it & poof its gone! @loll@

They have a rather clever disclaimer on the site, but really.......it would take a court case to determine if they actually have any genuine legal standing, of which I doubt they do. The biggest point of contention would not be about fair use, or that the site acts as a library--but that the material is being broadcast without consent of the various publishers-and in a manner that they are, by law, entitled to control.

The example they site doesn't work in my mind, because if the argument is transfered to a film being shown at this "library site" wherein all the arguments they make for a comic are used for the film, it WOULD be illegal and in violation of copyright. That is because they are disseminating the material via broadcast.

( They are also a DOT.COM sit--meaning it is a commercial URL on the Internet, which lawyers would contest that which implies the site could veer into a venture for commerce at some future point. If the site owners were smart, they would have made it a DOT.ORG site from the outset. And the site DOES have ads, which makes them a commercial venture!!)

See an owner of a film is, by law, entitled to decide HOW that film is to be shown. A good example is the original version of the Manchurian Candidate--which was owned by Frank Sinatra. For many years Sinatra refused to allow the film to be shown anywhere,or in any way. Legally, no-one could show the film without his permission--he retained the exclusive right of broadcast to it. Had a TV station or movie theatre gotten a hold of the film and shown it--even for free, he could sue them.

The comics pubslishers, under the law, retain that right as well to their materials. The owner(s) of the web site is broadcasting the material, using technology. It would be the same as if someone painted a huge series of murals, or put up billboards using the published comics, so that anyone can see them. The publishers retain the right to say how their stuff is used.

Additionally, materials archived in a library are donatedto a library, often with the stipulation that the materials come from the original owner with permission. The original owners would be the publishers, NOT someone who has bought the comics. Again, the publishers, by law, can reserve the right to have their material archived or not.

What the folks on the site have done is usurp authority over material they do not legally own, nor have the right to broadcast for others consumption, be it that consumption being free or not. Claiming they are a library doesn't save them, nor does making the stuff copy-proof. They are still displaying the material in a manner that is outside of the approval of the copyright holders.

The publishers and trademark holders of the various comics archived on the site could, at their discretion, launch a class-action lawsuit against the site and have it shut down, if they so choose.

Yea, the publishers could shut down that site very quickly and these folks would not have a leg to stand on.
