Help with Spider-Man figure

I was on HAsbro's website and found a picture of a really cool spider-man 3 movie figure I've never seen before. It is not available for purchase so I called Hasbro to get details on it. They said it was released back in april and is now discontinued. I know I have never seen this figure in any stores from april to now and I normally make it a point to look at the toy sections of stores. Here's a picture of the figure

 

Has anyone seen this for sale before?

limited release,i only heard one report of someone having it,and they never took pics

I've never seen it... the top half looks like a DC animated figure

its from wave 2, its the red to black spiderman

 

I have never seen it anywhere in stores, only 1 i am missing.

thanks for the information. I was hoping it would be a bit easier to find but looks like it's almost impossible.

I don't know this at all, but I feel that this figure never released, because, it was the only figure never on sale on hts and it was the only one I never found amongst the ridiculous overflow of spider-man 3 figures at wal-mart. Found all the others, even Mysterios and Black Cats.
